desperate for advice re: pip appeal

My 25 year old son is such a gentle soul. He has Dyspraxia, Aspraxia , Hypotonia of his lower legs and a form of higher functioning Autism. He has many many issues, like others similar to him. He was on DLA for a few years, we didn't realise we could claim until he was at least 18 so missed out on a lot. That said, we did the forms, and were turned down for pip. We asked for the consideration which was again turned down and on both, the only thing stated to his detriment was that although they conceded that he needed someone with him on a one to one bases, he did not need anyone help in a social setting, using the words that he did not need an interpreter.

I am so confused at this statement, how can he need someone with him one to one but turn him out into the real world, the one that terrifies him and he is supposed to be fine with no help? How do i fight this statement, They also said that we did not have up to date information, true we dont, but we live in a small town in the middle of nowhere, there is no help. The nearest autism group is over 60 miles or more away and we cant get him there.

We tried via the doctor who thought mental health might be beneficial to him but they were only concerned if he was suicidal which although he gets depressed and has dark low moods, is not the case. He is seldom sick as he rarely leaves the house so even our GP only knows him from his notes from the past. I am so so tired, but angry at their brutality against a young man who has no other choices. I have read so much on this site but I think my brain has fried slightly, I simply dont know what to do or how to fight this or the words to use. Please, can anyone advise me, time is running out as I have been unwell myself but its no excuse, I cannot let them do this to my son for the sake of 2 points, its so cruel :( Thanks in advance for anything

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an award will only be made by your showing that you score the extra points for one, so I would start by going back through his PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

Hi, I am certainly not an expert in any way, regarding PIP. However, I would say from my experience that if you look at all the information on here and go to citizens advice - they will help you fill in any forms to the tribunal on a step by step basis. They were wonderful with me and I was very prepared when I got to the tribunal. Good luck and don't give up. Follow the procedures, including time limits for things and focus on meeting the criteria for the points.
