Should I go to tribunal was created by Debbie
hi I have just received my decision after a mandatory decision and my claim had stayed the same I firstly was on high and high on d l a got moved to pip and dropped to standard on both which I went all the way to tribunal with and the decision stayed the same in sep 2016 .i have justimformed them that I had a full tyroidectomy in Man this year which had nothing to do with why I was on pip in the first place and they have just removed the mobility of it I carnt understand it becauce that was for my physical health I have a left leg drop foot need a right knee replacement have a trapped spinal cord fibromyalgia asthma and Raynaud's disease and really bad fatigue and depression I don't no were to turn anymore feel like giving up .

I would have a good read of our PIP Claim guide to make sure you fully understand the criteria for a PIP Mobility award.

If you think that you qualify then the next stage to the process is to request an appeal.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

I also wanted to ask aswell Gordon can you go against the medical becauce I feel like mine was a pack of lies for 1'the nursed didn't touch my feet or see me walk and she said I have the same power in both feet which I find hard as I have a left leg drop foot .

You can certainly raise issues about the assessment, but the panel's focus will be on seeing whether you meet the criteria to score points so this must be your focus for your submission.
