ESA and DLA are two separate benefits and eligibility for each is based on different qualifying criteria e.g. DLA is based on your care and/or mobility needs and the medical condition causing those needs is secondary. Whereas Employment and Support Allowance is a benefit for people who cannot work because of illness or disability. So being awarded one of the benefits doesn't necessarily indicate a positive outcome for the other because technically you can be awarded DLA and still work. .

Hi.

I was awarded ESA in december and then applied for DLA in febuary and was awarded it on the ATOS medical that i had in december for ESA (hope that makes sense) they did not contact my GP or any of my consultants.

Hi Karen

Thank you for your reply, i will keep my fingers crossed. Did you get esa from atos medical or did you have to appeal? The atos dr i saw wasnt very helpful and didnt listen to a word i said, it was a letter from my gp that allowed dwp to overturn decision the week before tribunal. With the additional info that i sent for dla i included a copy of the letter from my gp as the atos report was of very little benefit and i was only awarded 9 points, yet now i am in the support group!!! Once again thank you and good luck in the future.

Hi

Many thanks for your help and yes this does answer my question. I will let you know as soon as i hear although i was turned down 3 years ago so i went to tribunal and awarded mrc unnanimous decision so i am expecting to have to appeal once again!! Once again thank you!

Hi Julie.

Got ESA straight away on the result of medical.16 points but a lot of discrepancies in the report but did not want to appeal cos i counted myself lucky getting into the WRAG group first time.
Let me tell you i was shocked as i have read some horror stories about people having to go to appeal and still being refused.
Am already in a state as they said review at 12months which will be either end of september or beginnig of december.
Does anyone know when they say review at 12 months is that from the date of first making your claim or from when you have the medical.
