IB tribunal was created by Tizzy
I have ME/CFS Fibromyalgia I am due to attend IB tribunal on Friday. I suffered badly for nine years commencing 1989-1997 and then managed to get back to work..Bang four years ago back to stage one, I have been in receipt of DLA for the last two years and I know I will be starting this process again in March when they are due to contact me again,my end date is August 2011. Any tips Please as I am trying very hard not to get stressed about it.

Hi Tizzy

You can find advice on how to prepare and handle an appeal tribunal in the advice guides in the members' area.

Good luck with your hearing on Friday.

I had it confirmed on appeal that for the descriptors to apply you need to be able to carry them out:

"When called upon to do so, repeatedly, and without undue pain or fatigue"

ME rules out most descriptors in this case.

The primary issues for a fluctuating condition such as ME/CFS are the variability of the condition and reasonable repeatability. You need to think about how these issues affect your ability to carry out the tests in the WCA medical.

As examples;

If you can walk 200 metres once a week, but for the rest of the week you can only walk 100 metres, then for the majority of the time you can only walk 100 metres.

If you can stand for 30 minutes, but having done so could not do so again that day, the you should be deemed as unable to complete the test.

Hope this helps
