Hello Gordon,

Sorry but I was also thinking that I would ask people who I know for a statement to include in my papers, to show that they have seen me struggle with Communication and Engagement. One of these would be my daughter's Teaching Assistant who I have known many years. She is a nurse, so has professional qualificaitons and also has a daughter who will be (or has just moved onto PIP from DLA). She is also a mum and has seen me (and known when I have made excuses not to be at) social events. Is this worth doing?

There's some debate about this, undoubtedly letters from close relatives will be depreciated by the DM on the basis that "of course" they would support you, this would likely be less so for someone who is an acquaintance.

My view, such as it is worth, is that these documents add to the total view of your problems and are worth including when available.

They need to include their full name and address, there relation to you and how often they see you, finally they must attest that the information that they are providing is true and sign the letter.

Hello Gordon,

My tribunal date is set for last week of August. I have had a mental block about preparing for this and was away for a couple of weeks. Had hoped that the Hospital would have written something for me, so had to chase for this but they have promised this by end of this week so will it still be okay to send it to the Court?

You should aim to have all of your information with the Tribunal Service no later than a week before the hearing.

You can present, to the Clerk of the Court, up to one side of A4 on the day of the hearing.

The first point on the DWP 'statement of the facts of the case' refers to when I started the claim. DWP have said that I telephoned to start the claim on a specific date which I didn't. I wrote a letter to start my claim, approximately 5 weeks before the date they state and DWP wrote to me again before that specific date. I have copies of this correspondence so is it okay to include this to refute the incorrect facts? The fact they say I telephoned which as a deaf person I can't do and is a direct contradiction? Also I had two MRs as they messed up on the process (my claim fell into a black hole) but the 'statements of facts of the case' only refers to one DM who sent me the decision only giving me 2 points but no mention of who did the two MRs - should this person or people be mentioned on the DWP list? The name they give as the DM is not the named person on the Decision letter - again is this DWP's error? Also there are two pages missing from the Assessors report - I think these are blank pages but do I quibble this point? Also they have put my representative down as being the DM's representative? The assessor put on the report things like 'doesn't socialise, can't deal with bank, struggling to pick up conversation'. Basically when I read the assessor report, there's a lot that was left out and also a lot that never even got covered, even though I asked to talk mobility, there is no mention of this in the assessor report and I'm not sure where it would be covered - obviously I got no points for that.

You really need to concentrate on showing that you meet the criteria first and then go on to dealing with the issues raised in the report.

For example, if there is no debate over your being deaf then you should question whether there is any advantage is raising issues such as whether your initial claim was made in writing or over the phone. Also, the panel will not really be interested in how the MRs were carried out by the DWP, they are looking at your claim from scratch.

I would raise the issue of the two missing pages in the assessors report, it may be down to the TS not copying them.

If you can, try to comment on factual errors in the assessment report rather than trying to argue against the assessors opinion, as this will be more successful.
