I had been receiving DLA since I had breast cancer in 2006 and then still suffering severe side
effects from the treatment ongoing and had high rate mobility as I couldn't walk far. I was 67 in June 2016 and as I had a sit down job had worked up until December 2015 aged 65 and a half.
I was 67 last June but in April was asked to apply for Pip which I did and later received a home
assessment. At the time my breathing had deteriorated significantly and my asthma was not being controlled. At the time I was undergoing various tests and scans which were ongoing.
I received a letter from Capita saying I would not receive any benefits so made the mandatory appeal and received a letter in September saying I still would get nothing which said if I wanted to go to appeal I would have to do it within a month but I had just lost my father in law and was feeling very low and had been confirmed with COPD and a bone scan to my chest had picked up
a hot spot which they now think the terrible pain in my chest is a chronic condition due to the radiotherapy but they are rescanning me in April. My doctor is appalled and has told me to reapply but what I would like to know is if I can do this. Please can you help me I am distraught as I can't go out alone or without a car.

Although the normal period for requesting an appeal is one month you can make a late appeal up to 13 months after the date of the Decision, but you will need to provide Good Cause why the request is late, your father in-law dying should be accepted as this.

As you are now over the age of 65 you cannot make a new claim for PIP, only Attendance Allowance which has no mobility component.

If you wish to still appeal then the PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.
