let down by the system P I P was created by ian
let me start by saying hi,
my name is Ian,
I feel really let down by the system, Today I received a letter stating I had been turned down for P I P ....and im not sure what to do or where to turn I have never claimed benefits before as have always worked full time ,and only wish to claim what I feel I should be entitled to, until I was diagnosed with angina closely followed by severe anxiety which has severely impacted my life (and was advised by my doctor to apply for this)
I was awarded just 5 points for daily living and zero for mobility and frankly i would find some of the points awarded laughable if it wasn't so serious,
preparing food score - 2 (i don't agree with my partner wont allow me as i have burned numerous meals due to drowsiness from meds ,lack of motivation)
eating drinking - score 0 (i agree with ,although during severe bought of anxiety i can go days without food as i have no appetite )
managing treatment's - points1 (don't agree with i have to be prompted by partner most days due to anxiety meds and lack of motivation)
washing bathing points 0 (i agree with)
toilet needs 0 points ( i agree with
dressing and undressing 0 points (not sure about this one)
communicating 0 points - (this one has really annoyed me, whilst I was in 121 meeting I repeatedly broke down in tears due to having anxiety attacks brought on by stress of situation I find/found my self in ,which unfortunately is an everyday occurrence for me.
reading 0 points -(whilst I agree basic information does sometimes stick complex written does not, again im sure this is down to meds sometimes even basics don't stick and I will have to constantly refer back to the written statement )
mixing with other people 2points- ( I would say 95% of the time I spend I the house due to my anxiety even in company of people that I know I find it very difficult and experience panic attacks and anxiety I cant even go to a hairdresser without problems occurring ,again like I say I repeatedly broke down in the interview even though I was full of anxiety meds)
making budgeting decisions 0 points( not sure of criteria I leave this to my partner not motived/interested )
mobility
planning and following a journey 0 points - again I am note sure about this one ,but if they mean will i attempt to go anywhere by myself the furthest I will go is the school due to panic/anxiety attacks and even then on most occasions I cant even achieve this without having a diazepam)
moving around- ( in the my decision part of the letter it states that they witnessed me walking a whole 15 meters without using my GTN spray now had they watched me walk to my car about 150 meters from consultants room they could they could of witnessed me using my spray if they so wish I find it mind boggling they can give an informed decision of my angina from a 15 meter walk, but I suppose they can asses these things better than an angiogram a cardiologist and a bunch of specialists in this field
on a side note to this I need to add that the very people who carried the interview /consultation for this ,were the same people who gave me the consultation when I worked as I a warehouseman and said I was no longer fit enough to carry out my duties due to my angina and this was before my anxiety issues complicated matters further
so what can i do next any info help would be appreciated

I'll explain the process later in my post.

Preparing Food - you will need to argue that you need supervision.

Eating and Drinking - Have you looked at prompting?

Managing Treatments - If your problems are with medication then you won't score more than 1 point.

Communicating - The Descriptors for this are very specific, yo need to show that you meet these.

Reading - The standard for this is very high, if yo completed your PIP2 yourself then I think you will struggle to score for this.

Mixing with other People - This is about the time you are with other people, I understand that it may be a refection of your problems that you do not go out, but this can also act against you as well, try and stick to talking about the times that you are with people.

Going Out - You have undermined your case by saying that you go to the school.

Moving Around - The GTN spray may be classed as an aid and therefore not be seen as a problem, this is all about the distance you can walk.

Remember to consider "reliably" and on the "majority of days", which are explained in the PIP Claim guide.

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

www.benefitsandwork.co.uk/help-for-claimants/pip

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
