Good afternoon,
I'm looking for some advice as I have tried to speak with DWP but they've been nothing but rude towards me. I'm 26 and have been signed off long term from work due to having gout and inflammatory arthritis. My work sent me a letter a few days after I was signed off on the 04/06/17 to tell me they couldn't pay me any sick pay as I hadn't worked enough hours to be eligible. So I was advised as it said on the letter I received to contact the DWP, I was advised by them because I have a partner who works to claim for contributions based ESA, I handed all my paper work into my local Job Center for them to scan and send to the people who deal with ESA. I received a text to say that everything g had been received and it would take 2 weeks to process, at the moment it is a real struggle to pay rent, feed ourselves and pay any other outgoings on one wage. I called up today to see if I could get an advance on my ESA as I am literally at the stage where my cupboards, fridge and freezer are nearly empty and running out of gas and electric. I spoke to a lady who told me that ESA will only pay my national insurance credits which really is no use to me at this moment in time, I asked what else could be done as it really is a struggle each day and is effecting me emotionally. She told me nothing and I said well do you expect us to just go homeless and starve, it's going to get to that stage because I'm worried I won't be able to pay my landlord rent this month as it is a situation of pay my bills and go hungry. She told me to stop the sarcasm and go speak to my local MP if I was that worried, it just got me so upset and I hung up on her. I spoke with a friend who has been in the situation before and said something didn't add up with what I've been told, we can't apply for working tax credits as my partners income can rise and decline week to week and we don't have any children. We've already tried to apply for it but the claim got rejected, I then decided to call again to see if someone could give me some advise, again I was told because I signed on twice in the last two years I didn't pay enough national insurance. The women again was really rude and told me to go look for a job, I do have a job but I'm on long term sick and recently had a meeting with them where I was told I may be dismissed for capability because I am on long term sick leave and my condition isn't improving. I requested for the women to get a a manger to call me back because I was unhappy with the way she and her colleague spoke to me and I need someone to give me advice as what to do next, needless to say the manager still hasn't called me back and I'm now seriously worried about what will happen. I would love to be able to go back to work but the job I do involves being on my feet all the time which are affected by my conditions along with my back and hands. I did apply for PIP but I'm awaiting for a referral for a specialist so I felt that my application would be rejected due to lack of evidence to back everything up. I would be so happy of someone could give me some advice on the next steps to take with this.

From your post, you have made a claim for Contribution Based ESA, however, you do not appear to be able to meet the Contribution Conditions due to breaks in your working during the last two complete Tax Years.

If you made a claim for only ESA(CB) then you can look to see whether you can receive Income Related ESA, however, if your partner is working then their income may limit whether you can receive ESA(IR) and if they work 24 or more hours a week then you cannot receive ESA(IR).

Does this sound consistent with what you have been told?
