I sent in my mandatory reconsideration earlier in the week.

I have now received a letter from DWP ending my jobseekers allowance because they claim I am working more than 16 hours a week.

In my permitted work i was doing 10 to 12 hours and when attending my initial jsa interview they agreed that i should only look at part time work because of my conditions.

I have no idea where this has come from. Is it part of the dirty tricks campaign?

I'm afraid the only way to deal with this is for you to request an MR of the Decision, you should certainly ask for the evidence that they have that you are working this amount of hours each week.

it has been quite a surprise, do you have any idea on how they could base it?

any wages from my permitted work have been declared to dwp, I am at a loss about how they could pertain that i have been doing more than 16 hours a week.

It is my initial impression that this is part of a dirty tricks campaign, A weeding out, wrag was the first step, now anyone who demonstrates any usability gets kicked off.

considering i am due in on wednesday to meet my appointed worked at the local job centre and my doctor has given me a fit note to mid may it is very strange.

I sense new and much more difficult policies at dwp in truth.

also i would advise anyone not to get conned into doing a bit of permitted work to get them off your back, it looks like they use it against you.

Thankfully it turns out that this was a mistake.

My local job centre had informed DWP that I was starting work as a van driver for manpower. I do not even hold a driving licence.

I am onto the local job centre now to correct the mistake.

All to update on this which has been tortuous.

I am awaiting the results of my mandatory reconsideration but the process of reverting this false report of my starting work as a van driver has been difficult.

DWP Belfast admitted it was a clerical error and it got sent back to clerical and it took around a week to be sent live or active or so I was told.

I contacted housing benefit to let them know that and was informed that my claim was not live on their computers.

I have been back to DWP and they have said that although my claim is active I have to do an EB7 form relating to the permitted work that I was previously doing.

Any idea what this is? Rather than the claim just being made active, it is yet another hold up and my benefits have been suspended for two week now. I was hoping that the matter would be fully rectified by now and this has knocked me back.

I'm afraid I can't find anything about an EB7 form.

When you receive the form, it might speed things if rather than posting it, you make an appointment at your local JC+ office and they can scan the completed form and email it directly to the department that needs it.

Thanks for all help - this was an b7 form and also an a15 form about the permitted work that i was doing. i have now done these.

Sadly the mandatory reconsideration didnt go my way and was rejected. I think ultimately the fact I had been doing permitted work counted against me.

This has all been immensely stressful as you might be able to tell. My employer has offered me 16 hours a week to look to do onto disabled working tax credits which would mean that i would only lose around £50 in benefits a week.

I did think that going from esa to working tax credits was a sure thing and am planning to do this in the new tax year (I really cannot cope with the stress of the job centre in any way).

However Ive received the notes and it appears that you have to qualify on a separate disability criteria.

I am sure that I qualify for 3 or 4 of the criteria

I am awaiting therapy for mental illness
I am often confused and forgetfu

Due to my problems with depression and other physical problems i work from home and in no way can i normally sustain an 8 hourha working day or 5 day working week.

I am also undergoing treatment for my physical problems and have upcoming hospital appointments for these - my doctor is aware of this and will be supportive - I am currently under a fit not,

My questions are when i send the form back - it only asks do I qualify for disabled wta and say it will ask for a doctor or someone to verify.

Should I also send evidence with the form or will this be followed up and asked for separately,

I am also wondering if if should send evidence to dwp and or hrmc outlining all this so it is on record.

You see I dont not what them to take the medical report unchallenged if and when they are taking a decision.

If anyone has any experience of this or can point me in the right direction then great.
