TOPIC: NEED A REPRESENTATIVE FOR MY ESA TRIBUNAL

Re:NEED A REPRESENTATIVE FOR MY ESA TRIBUNAL 7 years 10 months ago #14563

  • Simple
According to the Appeals Guide i should know the name of the doctor sitting on the tribunal panel. However, there's no mention of this in my tribunal letter/bundle. Is this important to know beforehand?

Secondly, is it ok for me to hand the clerk new supporting evidence/letters on the day of my tribunal?

"The letter will also tell you the name of the doctor who is to sit on the panel. If you know the doctor you should contact the Tribunals Service straight away. The Tribunals Service will then either to arrange for the doctor to be
replaced, if that is possible at short notice, or have the hearing postponed." (p.26)

Could someone please confirm this.

Eagerly awaiting a reply!

Many thanks :)

Hi,

It's important to know the name of the medical member sitting on your tribunal, to ensure that they haven't treated you in the past.

I've only ever sat on DLA Tribunals, but the case bundle always gave the name of the Chairman, the Medical Member and the Disability Member.

It is permissible to hand to the Clerk to the Tribunal, new/supporting evidence on the day, so long as it's not too long.

Ideally, it's best where possible to send any supporting evidence in advance, in order that all tribunal panel members have the opportunity to read it thoroughly before the day of the appeal.

Tribunal members are normally sent the case bundle around 2-3 weeks before the date of the appeal for the reasons given in the paragraph above.

Hope this helps.

Jim
