Help please telephone ass but no form issued

Hi, I have decided to go down the MR route. My daughter is in hospital again!! Due to her health conditions and I am so angry about this whole situation, it’s so distressing and time consuming. I need to be there for my daughter, not filling out forms etc!. I will come back here and let you know how we get on. I’m not giving up, Thank you for your advice.

Power to your elbow Nother. Don't forget that if you do not have the time to fill forms fully while caring for /visiting your daughter, you can send in a brief MR request to catch the deadline. In it you can say that as your daughter is unwell in hospital you will submit full reasoning when you are able, and for them to please not consider the MR until they receive this. Copy in your MP so they are in the loop, making this clear on the DWP's copy as a little bit of pressure. Then if the DWP still try it on acting super unreasonable, the MP's office will already be aware of the situation.

Well MR also rejected, so now going to appeal to tribunal. I will be submitting the form online on behalf of my daughter as she is just not well enough to do it herself. Despite reading all the amazing guides and advice on this wonderful forum, I’ve obviously gone wrong somewhere but it’s so difficult trying to keep everything afloat, looking after my daughter, Grandaughter and just trying to juggle life in general. My own health is going downhill too, I’m so tired, emotionally and physically but also so angry!! The DWP state that my daughter is able to look after herself because she looks after her daughter! We clearly stated in our Mandatory Reconsideration papers that my daughter is now staying with me because she needs so much support and is unable to care for her daughter because of her condition. My daughter can’t even eat properly as eating leaves her in excruciating pain and she needs to use the toilet almost as soon as she puts any food in her mouth, if it wasn’t for myself and her father,she wouldn’t eat at all because she avoids food as much as possible in order to get some respite from the pain. She’s 23 years old and weighs a tad over 6 stone. The DWP states that because she eats toast and dry pasta (these are the only foods that my daughter can just about manage) she is getting sufficient nutrition!! And oh, because she used to get a bus to work 4 years ago, she has no mobility issues. It appears that everything we have tried to explain to these twats, have been completely ignored. Sorry about the rant but I just don’t know how much more I can take. Do I explain all my reasons for appeal on the online form or do I write this up separately and post off after with reference number etc? Also, I’m confused about medical evidence, I intend to get more medical information together G.P. Notes etc but I’m sure I read somewhere on here that the tribunal panel is not really interested in medical evidence, that they focus more on the applicants personal account?? If I wasn’t so angry, I know for a fact that I would just give up but that’s exactly what they want me to do. It’s the anger that is giving me the energy to persevere. My mind is so jumbled I’m finding it really difficult to process all the information here to assist me with the appeal. Please advise.

I am so sorry that this has happened to you and your daughter. I'm sorry that you are battling your own health issues but glad that you are not going to give up. You have a greater chance of winning at the tribunal than you do at the mandatory reconsideration stage. Don't be hard on yourself - it sounds as if you did everything possible to try and turn around the decision. It is absolute nonsense that anyone can consider pasta and toast as a balanced diet or that she does not have weight issues. I'm not surprised you needed to rant. The bus issue is also ridiculous, but that is the DWP for you.

When you fill in the form online - put in the reasons for the appeal. If you don't get them all - you can submit evidence later. I certainly would get additional medical information if you can. The panel will be interested in your daughter's account, but there are medical professionals who will look at the evidence.
