ESA income-related - Carer Premium affecting Pension Credit? was created by frmarcus
Hello:
Claiming ESA (IR), would this affect (reduce) my mother's Pension Credit if I claim ESA Carer Premium (CP)? I know it would if I claimed Carer's Allowance - but can I just claim CP without it doing so? My mother received Attendance Allowance so gets extra PC for that, which is what I believe she loses if someone claims CA for providing care. Is this ALSO the case if they claim CP (or is the claim for CA and CP the same)?

Hi frmarcus
If you mother is living on her own or lives with someone who gets a qualifying benefit then she would be entitled to claim a SDP with her GPC as she is in receipt of AA.
If anyone claims a carers premium/allowance because your mother gets AA then the SDP component of AA would be cancelled.
CP is paid when someone claims UC, and yes it will affect your mother GPC.

Gary: Thank you. CP is ALSO payable (in principle) with ESA (IR), isn't it? It's Carer ELEMENT with UC, Carer Addition with PC and Carer Premium with ESA. Just clearing this ambiguity up...
UC is irrelevant to this enquiry - but you answered the question that whether Carer Allowance or Premium is paid it would reduce SDP in PC.
I do find the effects of CA and its different forms on other benefits horribly confusing to work out given that both claimant and cared-for can be affected.

The Carers Premium is only payable if a Carers Allowance claim is in place.
Do you know if you are also entitled to Contribution Based ESA?
If you are then CA and the ESA(CB) are classed as over lapping benefits which means that only the highest will be paid, usually the ESA(CB). If this is the case then your mother's SD Addition will remain in payment as the CA has to be in payment to stop it and you could also receive the Carers Premium.
