Disability Premiums, Disability Income Guarantee, SDP and Benefit Cap Exemptions

LONG POST ALERT - PLEASE BEAR WITH ME

Back in 2017 I was awarded ESA CB and Support Group. Back in 2020 I was sent a letter with my award and a new line for Disability Income Guarantee.
According to the Gov dot UK website to get this Disability Premium you must be in receipt of PIP Daily Living (which I am) and under Pension Credit age (which I am) I also live alone and have no one in receipt of Carers Allowance for me.

To add to the confusion in 2022 ESA IR was added to my award along with SDP (ESA IR had been switched on and off from the start of my claim back in 2017)and I have always been exempt according to the calculations for the Benefit Cap but never received the payment for either ESA IR or the SDP yet I do get payment of the Disabilty Premium.

Why would I be getting one Disability Premium which entitles me to the SDP but not acutally receiving the SDP if I am exempt from the Benefits Cap - is this not a contradiction in terms?

I've been trying for nearly two months now on a daily basis at different times of the day to contact ESA to get clarification on this I also wrote to them in 2021 (just received a FOI reply on info they have on me and the letter is there in the pack) but received no reply from them. How the hell are you so supposed to resolve queries if you can't get through to them or receive no reply to letter queries.

This whole thing is as clear as mud Gov dot UK provide the information but the agents are interpreting things differently.

Confused and getting no where fast.

I can hear the frustration in your words, at the moment it is not easy in trying to contact ESA, best time to try and contact is first thing in the morning 0800 169 0310, if you tried today you would not have got anywhere as they are on strike. Remember Monday is a bank holiday so don't try then.

You do need to see your local Welfare Rights Organisation, who can take all your circumstances into consideration; advicelocal.uk

I will see if I can give a little explanation; you can be awarded both IR ESA and CB ESA at the same time, you usually get awarded CB ESA first then if eligible for any disability premiums you the get awarded IR ESA as a top up.

If you are in receipt of the Daily Living component of PIP then you will not be affected by the benefit cap.

You will receive the Enhanced Disability Premium if you are in the support group of ESA

To get the Severe Disability Premium you must be in receipt of IR ESA.

Gary what is the difference between the enhanced disability premium, and the severe disability premium, in relation to monies ?

Does it mean a claimant gets both of these premiums.

I am on IR ESA Support group, and also PIP daily living enhanced rate, and mobility at standard rate.

Does this mean i get both of these premiums.

The current rates for a single person are;

EDP - £19.55/week
SDP - £76.40/week

You meet the criteria for payment of the ED Premium due to your being in the SG and/or having a PIP Daily Living award at the Enhanced rate.

You will meet the criteria for the SD Premium provided you live alone or are considered to be living alone.
