A result at last

After a two month date after his assessment was cancelled, we have recieved a decision. My husband has been placed in the WRAG.He is contribtions based,which is the one that will stop after a year if the bill goes through parliament, although his letter did not say that bit.

Can someone just confirm for me- if you are in WRAG, do you still need at least 215 points as I don't undestand how you can walk only 20 m until needing to stop and still be placed in the WRAG. It may be that I have misunderstood this fact.

They did not write any reasons for why they made their decision, but unforutnately, a key letter with evidence, did not come through to us until about 3/4 weeks after the form was submitted. We do not know if they were sent it by someone who sent in evidence ( they said someone had sent in evidence which is why they caceled the asessment).

Is a reconsideration the best thing here, or an appeal if we do feel that he is placed in wrong group? I am trying to get through to DWP to ask why they chose the WRAG, befire making any decision.

If one has been placed into the WRAG, it means they must have scored, or be treated as having scored at least 15 points in the Work Capability Assessment.

If one is placed into the WRAG, then n order to get into the Support Group one needs to meet one of the descriptors necessary. These are as described in the ESA guides in the members area.

Whether you appeal or ask for a reconsideration if you think your husband should be in the Support Group is down to your husband. if one does actually appeal then a reconsideration is carried out anyway. In doing either there is a chance, usually small, that he could lose his WRAG status and be found fit for work, particularly if a medical (WCA) is carried out at the reconsideration or before the appeal stage.

To appeal he will need to complete a form GL24 – If you think our decision is wrong form.

It may be worthwhile obtaining some face to face advice from a Welfare Rights Agency/CAB etc both to ensure the relative safety of his current award and to assess the realistic chances of getting his award increased to the Support Group.
