Is there anyone who is in the same situation as my daughter. She has been receiving ESA since August but this morning she received a letter saying that her claim has been suspended. In a separate envelope she received form ESA50 03/11 She rang the office concerned and was informed that she needed to fill in the form and attend a medical and if she gets through the medical her claim will be backdated. Surely, this cant be right she has a daughter aged 11 how is she suppose to support herself and the child. It could take weeks, months before she gets to the medical stage.
Any advice would be appreciated.
Hi S,
This is not a straightforward ESA query.
The first thing that you should gain clarity on is, are the two issues connected?
In that, is the notice of suspension of ESA connected to the issuing of the ESA50.
The ESA50 is not usually issued in normal circumstances unless the claimant is due for a re-assessment,(unless this is not a migration from IB/SDA/IS,and is a new ESA claim, and one is in the assessment phase of ESA) this will depend on the length of the original ESA award.
Further, it is not upto the person on the phone to tell you that your daughter would have to have a medical, this is upto the ATOS HCP who will carry out the assessment.
I feel that you need to gain clarification as to why your daughter's ESA has been suspended, and why an ESA50 has been issued?
As this case is not of the norm, it may be advisable to obtain face to face advice from the CAB or other advice agency.

My daughter has written to the Benefits office asking for clarification but has heard nothing from them as yet. She is not receiving any money from anywhere at the moment and is at her wits end. Is there anyone who can advise whether she is able to claim any benefits whilst this is being sorted.
