My husband has been in the WRAG since November 2010, prior that he was on I/benefit, took a part time job but found it too much for him.
He received a letter at the beginning of March stating that ESA was coming to an end and a form to fill out, asking about any change of circumstances. We sent the form back listing his medical problems, yesterday received a further standardized letter stating exactly the same as the first, that ESA was coming to an end
We contacted DWP by telephone today only to be told if I work more than 24 hours a week he will get no benefit.
We were aware of that as I do work full time, but want to apply for him to be in the support group not sure how to go about this due to the amount of time he has been in this group, his health has got considerably worse and his consultant has stated no way should he be working
No one has contacted him whatsoever either my phone or letter(apart from one quick phone call and sending him details about pension credit, since he first applied. He is 20 months away from his state pension.
He has had one medical when 2010, another medical form sent to us over a year ago but nothing else received. He is happy to attend any further medical, how can he appeal against a decision that was made in November 2010.

Hi Kirky, you cannot appeal against a decision that was made in December 2010. What you can do is ask for a supersession (re-assessment) on the ground that your husband's condition has worstened to the degree that he now qualifies for the support group. It will be up to you to supply evidence of this.

Your husband can request a supersession or re-assessment of his condition. He will need to show that his condition has deteriorated and that he now meets one or more of the Support Group criteria.

Qualifying for the Support Group

His payments will still cease as you have been previously notified, if he is placed in the Support Group then his ESA(CB) will be re-instated, if he is placed into the WRAG, then he will be eligible for NI Credits which count towards his full State Pension.

Hi
I am very confused about the entire process.I just recieved the letter this week that they will be telephoning me in 2 weeks.I suffer from Post Traumatic stress disorder(Re Omagh Bombing),Arthritis in knee(unsuccessful keyhole surgery),Depression and alcohol dependance.Since i recieved this letter my mental state has deteriorated rapidly and i dont have anywhere to turn or dont know what to do to stop this process as i am simply not mentally strong enough to go through with this all.I have had questionaires in the past and they always were happy enough without calling me to a medical.Should this be the same this time or will they most likely call me to medical regardless.I am genuinely unwell and unable to work and even if i was fit for work there are no jobs.I am really at my wits end here.Can anyone please advise.

Are you currently receiving IB, as it sounds as if the DWP are about to transfer you to ESA, rather than time limit your claim, which the rest of this thread is about?
