CAB said my partner had too much income.
However i have read all info on your site and it seems I do qualify because my partner has taken early retirement to look after me so therefore he is not working. In addition he is in receipt of IB. Could CAB be basing there judgement on his having a private pension. Shall i go ahead and accept it ............... confusion once again.
Overpayments, even when you can show that it is the DWPs fault, can be very difficult and time consuming to resolve.

contacted benefit adviser at dwp. She said i dont qualify for ESA (IR) because partner is in receipt of occupational pension. After explaining he took early retirement to care for me she insisted proof of partners income to be submitted to DWP. Is this request compulsory. Also my partner is in receipt of IB. Is this means tested. She also said i do not have to attend WFI because my appeal to be placed in suport group is ongoing and i am presently not in receipt of ESA.
Is it possible you can clarify above information is correct. I am becoming increasingly anxious and have informed by doctor of this..........

All income related benefits such as ESA(IR) are claimed a couple, where a partner exists, even though the claim will remain in your name.
As such, the DWP, as a condition of entitlement, are allowed to request yours and your partners finacial details, which include your partners IB and any pension income he has.
IB is not itself means tested, but counts as income in relation to a means tested benefit such as ESA(IR).
As you are not currently receiving ESA payments, you are not required to attend WFIs, however, if you are found eligible for ESA(IR) and as a result, continue being placed in the WRAG, until such time as your appeal is heard, then you would be required to attend.

WFIs are a mandatory requirement for members of the WRAG, although it is possible for them to be held over the phone or in extreme circumstances, in your own home.I've just been reading this and I'm really upset because although I'd be grateful to get esa at all I can't face the fact of having to go to work focused interviews at all not even 1. What can I do if this happens because I have already been thinking if I do get in the wrag group I probably wouldnt appeal to go into the support group for a while as I couldnt stsnd the stress and don't want to risk losing it at all sowould I have no way or avoiding these wfi?
