Hi

I am submitting an appeal of behalf of my son who has Asperger syndrome - am I right in thinking that

'suffers from specific disease or mental disablement and by reasons of such disease or disablement , there would be substantial risk to mental or physical health of any person if that claimant were found not to have Limited Capability for Work Related Activity'

The risk to mental and physical health of any person - includes him?

I am sorry but you cannot assume this. There are no conditions that automatically entitle a claimant to ESA.

Like any condition, Aspergers, can affect a sufferer in a wide variety of ways, in some cases there may be little impact in others it may be severe.

Unfortunately the Exceptional Circumstances, always require the claimant to prove their case, so you will need to provide compelling evidence that this would be the case for your son.
