Hi, Just back from Wrag interview, the advisor was a really nice guy. He understood my disabilty and said I'll see you in 12 months which Im happy with. I thought you had to do six appointments a year. I have appealed been put in wrag as I honestly should be in the support group, so I assume that I wont have another Esa50 for another 12 months then.

Although the JC+ interviewer can defer/cancel Work Focussed Interviews, that should not be taken as any indication of how long ones award of ESA is. That (length of award) is made by a Decision Maker generally on the prognosis advice given by ATOS Health Services. You can ask for your Statement of Reasons and other forms relating to your claim which should tell you how long your award has been made for.

my doctor told atos i need a home visit they sent the esa50 back to dwp, i was put in wrag without medical, i appealed and was told it will be a few months as backlog, i asked for all information Statement of reasons etc(as advised on here) and have not received any information, went to wrag interview and was told he will see me in 12 months,
If Atos request another eas50 filled in and im put in wrag again then i should still not receive another request to attend an interview before June 2013, by that time I might be in Support group

Hi,
It is entirely possible to have two (or even more) appeals outstanding at any one time.
Should your first appeal not be resolved by the time a 2nd ESA50 is due to be sent back back and a decision made on this 2nd ESA claim, if that decision is adverse you can appeal that one as well.
Technically it should not really happen, but with the waiting list for appeals getting ever longer, it is something we may see more of in the future.

thanks Pete I never knew that. i think that is madness as you could lose one appeal and win the other, so what would happen then.
Hi,
In effect the latter appeal would supersede the former appeal.
It can as you surmise get mightily complex hence for anyone in this position I would really advise they seek help from a reputable welfare rights agency/CAB etc.
