me and my husband were on Ir esa but he failed his medical, as i thought his medical history is enough. we appealed the decision but i wasn't able to deal with paperwork involved so eventually withdrew the appeal from tribunal. he never went back to work, I started working 24h a week, his condition worsened significantly, so I applied again for esa. after over a month of waiting i received 11 - yes eleven letters from DWP, all marked with the same date 21 june 2012, but no one in my local job centre was able to explain to me what is going on.after calling DWP was told that we do not qualify for ir Esa because I work 24 hours. He will be put in contribution based Esa, but none of the letters confirm that. what i understood from the letters that our case was heard by independent tribunal(??? when was that?) and we are not entitled to further benefits, some letters are asking for housing costs, some indicating weekly benefit, one is P45 with reference esa500, but I was told to ignore them. Is this the case with 24h working rule? Is it 24 (or more hours) or more than 24 hours? working rule? If i work 23 hours will he qualify for ir esa?
any answer will be greatly appreciated.I don't know where to go with all this letters and what to do next...sooo confusing...
