I received a date for a esa reassessment appeal on sat for the 12th July. I was put into the wrag without a medical for fibromyalgia,osteoarthritis but looking at the notes receivedf with appeal info, it doesn't look as if my depression/anxiety has been taken into account at all. I had enclosed a letter from my doctor and cpn at mental health. I had appointments to see both for further letters of support but not until the 3rd + 5th which is too late to get to appeal a week before. I also wanted to see if i could get someone to represent me. I phoned to see if they would be considered on the day which is unlikely but was told I could ask in writing for a later date. do you think this would go against me or evn be considered?
You are entitled to ask for the hearing to be adjourned until a later date, however, it is at the discretion of the judge.
This "should" have no impact on your case as you are currently representing yourself, but the feedback from other forums is that judges are taking exception to delays, where a representative has been retained.
If an adjournment is not granted, then you should send your evidence as soon as possible to the Tribunal Service, and take at least five copies with you on the day of the hearing.
