Based on your description of the circumstances, they will be treated as a normal claimant.

Hi gordon, thanks for your reply.

You say he will be treated as a normal claimant, despite being treated for prostrate cancer and will need surgery shortly, and also needing 8 wks recovery. (I forgot to say he will be having radiotherapy also).

Is it normal not to be fast tracked in these cases. Also how long on average does a new claim take to be processed, or will it be stuck in the system along with the rest of them?.

As I understand it, the only people who are fast-tracked are those who have less than 6 months to live. Everyone else has to go through the system, however long that takes.

If they are recovering from receiving, intravenous, intraperitoneal or intrathecal chemotherapy or they are likely to receive such treatment in the next six months then they should be treated as having limited capability for work.

However, this does not mean that they will, by default, be excused the ESA claim process. At the very least they will need to apply for ESA and complete and return an ESA50, it is possible that a Decision can be made based on the contents of the ESA50, but I do know of cases where the claimant has still had to go to a medical, and has only been after this that a Decision has been made.

Thanks Mrs Hurtyback,

He is now wondering whether it is worthwhile going through the whole esa/dla thing, as he is hoping to get back to work as soon as he is able. Are claims ever processed within the 4wk time, or is it always longer than this. He is just very worried about bills in the meantime.

In my experience, the assessment rate usually gets paid pretty quickly. However, it can take months for the decision to be made as to whether ESA is granted and which group someone goes in!

Remind your friend to check whether he has any critical illness or income protection, this is sometimes linked to a mortgage.
