My reconsideration came back yesterday with no change. I doubt they even read what I had written so now I am going to appeal.

I am now worse than I was at my last assessment when I saw a nurse and was put in the support group. I had to be helped out of the Jobcentre last week by the advisor because I could not walk - my doctor gave me a 'fit note' that morning so I don't have to sign on at the moment.

I don't visit my doctor very often as they've said there isn't much they can do other than offer me painkillers and anti-depressants. My condition is congenital and I have severe arthritis so it's not going away! I know my doctor's notes are incomplete or non-existent as it was noted on the ESA85 that my doctor didn't mention my anxiety for which I was prescribed anti-depressants.

I'm not looking forward to any of this!! Thank you for the advice and help, I really appreciate it! :o)

The next stage in the process is for you to request an appeal. There are links to the SSCS1 form that you will need to complete and instructions on how to complete the form in the ESA Appeal guide.

Once your appeal has been accepted and the DWP have received notice you can request that you be paid the ESA Assessment rate until your hearing, which will allow you to close your JSA claim. You will need to provide Fit Notes to cover the period.

I got a call to tell me I had won my appeal and didn't have to go to Court. They gave me 24 points and allowed me to stay in the support group. It just seems like a random 6 points per section and in my opinion isn't right either. I don't really want to rock boat, whilst this is good news as I didn't have any evidence as I never go to the doctors and only had my previous assessment which was done by a nurse and a couple of hospital letters, they decided I was not able to mobilise more than 200 metres or repeatedly mobilise 200 metres - which I can't do. This is is a lot more than my Pip which is no more than 20 and less than 50 metres.
I had asked for a mandatory reconsideration as I can't even walk the shorter distances properly as I have to stop so often from the offset due to the pain in my joints, that I no longer go out. This was about two months ago and I have not heard anything and wondered if this was because of my appeal and even if not, is this decision likely to affect that one?

Hi Jay,

I am very glad that your claim was decided in your favour without you having to attend court.

It is unlikely that this has held up your PIP claim, the 2 departments have little to do with each other.

You can send the ESA report to the PIP assessors if you believe it will be favourable.

That's a small mercy good to know! The ESA one isn't favourable and I did send the Pip one as part of my appeal. It's probably best not to poke the bees nest!
