The fundamental question is where does it leave him? If he is now no longer entitled to ESA with a degenerating condition and the same responses to the ESA50 as on the previous questionnaires, could they claim that all the benefit he has received over the last 13 years was obviously erroneously paid and must now be repaid?

No this is not the case, each Decision is separate, there will be no attempt to recover the money already paid.
