Providing you are appealing a Fit for Work Decision and it is the first that you have had then yes, you should be entitled to the Assessment rate while you wait for a hearing.
If you failed to return your ESA50 or to attend an assessment or this is your second Fit for Work Decision in a row the you are not entitled to the payment.

If your ESA payments were stopped as a result of the 365 day rule then you won't be entitled to payment while appealing as it is considered to be part of the same claim.
Have you checked whether you are eligible for Income Related ESA? ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See
