Won appeal but awarded CB ESA was created by Pedropete
Firstly can I just thank everyone on this site for their help, advice and information as without it I doubt I would of succeeded.

Anyway I went from 0 points to 21 points at the tribunal and was placed in the WRAG group. However having received the letter it states I have been awarded Contribution Based ESA with a top up payment which will last for 365 days and if I wish can enquire about getting IB ESA by contacting them by telephone.

My questions are:

a) Is it right that I have been awarded CB ESA as I haven't been able to work for around 12 years

b) Would I be automatically transfer to IB ESA once the 365 days were up as I know I would qualify and I would prefer this as I feel uncomfortable talking to them on the phone or would I be better contacting the organisation that represented me and let them deal with it?

Hi Pedropete,

Everyone who was on IB is being transferred onto contributary ESA, those on income support (for medical reasons) are given income related ESA.

As you already get an income-related top-up,I believe you should automatically transfer to IR ESA after the 365 days.

That is correct MHB, :)

If PP receives both CB ESA and IR ESA, then the payments should continue after the 365 day limit, as long as his personal circumstances do not change, and he remains entitled to ESA in The WRAG.
