Hi Gordon,

Thank you for the link. I had a read of it last night and although it sounds like it could affect me. I'm not too sure as I've heard it will only affect people that were assessed after March 2017. Which wasn't me.

Just to recap...
I was awarded 10 points back in 2014 for planning and following journeys (with d. Cannot follow the route of an unfamiliar journey without another person).

When I asked them to look again in Jan 2016 they got back to me in April 2016 awarding me 4 new points for moving around (due to reduced mobility from a new physical diagnosis) but they had reduced my planning and following journeys to 4 points (for needing prompting to undertake a journey).

With CAB help we sent a mandatory reconsideration to ask them to look at that question again but they said and I quote.
'The evidence indicates you have difficulty going out due to severe anxiety but are able to go out if you are accompanied. The evidence does not indicate you have cognitive or intellectual impairment. I cannot therefore change the decision on this activity.

I'm confused whether I'll be contacted as this was in 2016.

The DWP do not have to re-visit any Decision prior to February 2017 as this is when the Three Judge Decision applies from, however, it's unlikely that they have processed 160,000 PIP claims just on mental health in the interim, so this suggests that they are going back further, but it is at their discretion.

Thanks for your reply. Ok so it could happen but I'm best to not hold my breath.
The criteria change back in 2016 wasn't fair. I hope they see that.
Would ringing them do any harm?

Hi Gordon,

My husband rang DWP for me and they just basically said the date they have been given is Nov 2016.
If that is the case my pip won't be looked at.
I'm thinking of getting my mum to write to my MP because I just don't think it's fair.
The criteria changed earlier than Nov 2016 for Pip mobility q1 didnt it? Even if the actual words were not changed the criteria was. Am i right in saying that?
Is this why they are referring back to the 2015 regulations?
Or am I wrong?
Will the new criteria still be you have to have cognitive or intellectual impairment to be able to achieve can't follow a journey without another person?

Sorry if this is confusing. I am not great with words and explaining things.

Do you think it's worth writing to my MP. Do I have a case?
