I've just won my appeal for my ESA and have been placed back into support group. As far as I'm aware I am no longer eligible for contribution ESA and will now be on income related. I'm going to be moving in with my partner within the next few months and wish to know how this would effect my ESA. He will be working 38 hours a week and on around £25k year.
Would his wages and hours cause me to lose some or all of my ESA? I would go to my local job centre to ask them but unfortunately they are incompetent fools and never give out correct information!
The Tribunal Decision remakes the Decision appealed from the date it was made so providing your ESA(CB) was stopped as a result of the 365 day rule and not for some other reason then you should receive ESA(CB) as you are now in the Support Group.
If you move in with your partner then his wage and the hours that he works will prevent payment of any Income Related ESA, but the ESA(CB) should not be effected.
