Hi,sorry to bother you again but I've been told by others that if my appeal has been accepted , awaiting tribunal I can claim basic rate ESA whilst waiting. Is this the case in your view? Many thanks. Jox.

Providing you are appealing a Fit for Work Decision and it is the first that you have had then yes, you should be entitled to the Assessment rate while you wait for a hearing.

If you failed to return your ESA50 or to attend an assessment or this is your second Fit for Work Decision in a row the you are not entitled to the payment.

This is my first appeal. It's to go from WRAG to support group ESA. I failed at MR. ( my ESA WRAG payments stopped in May this year.) I have a sick note for 6 months from GP. What's the best way to go about claiming assessment phase ESA, if you still think I can? Many thanks again for your help.

If your ESA payments were stopped as a result of the 365 day rule then you won't be entitled to payment while appealing as it is considered to be part of the same claim.

Have you checked whether you are eligible for Income Related ESA? ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See
