Hi all I'm new to this.
Yesterday I went to my tribunal.
Awarded standard mobility and that's it.
Nothing for daily needs. I have chronic fatigue and pain and hyper mobility and I'm on lots of medication. I take 140mg of mophine plus an extra 30mls of oramorph. Plus various other medications.
I'll be appealing this decision as when on DLA I was awarded high on both criterias.
I just don't know what else to do. I need help with appealing to upper tier tribunal.

Please help me. I'm so devastated my appeal was went to be heard in December and got put back to April 13th so that was another 4months getting into debt. And having more stress.

I'm sorry that you are going through this :(

I'm afraid that you cannot take this further unless you can show there has been an 'error of law'. Your first step towards this is to request a 'Statement of Reasons' from the Tribunal Service. (DWP will also get a copy of this and, if there is an error, might decide to appeal against the award you were given). This must be received by the Tribunal Service within 1 month of the date of decision.

What is an Error of Law?

You should try and get qualified legal advice when you receive the SoR (which can take some time to arrive). I believe that Legal Aid is still potentially available for Upper Tier Tribunals (depending on your financial situation).

On the other hand, if you can show deterioration in your condition since the original decision, you can ask for a reassessment. This would entail another form to complete and, probably, another face to face assessment.
