Mandatory Reconsideration + Mobility Car - PIP

My friend has just transferred from DLA to PIP and has lost the higher rate award. She has submitted a request for a Mandatory Reconsideration, and has now received a letter from Mobility informing her that she has to return her car by 1st May. She relies on the car for door to door transport to her office, thus enabling her to work, which has greatly helped her mental health.

Without the car she will be unable to get to work, it seems grossly unfair that the car has to be returned before the decision has been ratified or overturned. Please could you confirm that this is the correct procedure.

Apologies if covered elsewhere, I have looked but have been unable to find it.

Yes, I'm afraid this is correct - although it does seem rather sooner than we have often seen. What is the date of the PIP decision?

A quick update: - I helped my friend to submit a Mandatory Reconsideration request, and advised her to send a copy to her MP. Her MP has now contacted her with the following information which he received from ATOS, following a review by a Client Relations Medical Advisor (CRMA)

"We have received a complaint via the Claimants MP that raises issue with the mobility section, specifically activity 12. I have completed a clinical review and I feel that the HP has not fully considered the safety aspect of the claimant mobilising. She has a long history of Neuropathy in her hands and feet, reporting constant numbness. She also has one leg shorter and uses a walking stick to aid her in mobilising. The aid has not been able to prevent her from falling in the past and the HP comments that she had an altered gait and walked at a slow pace. Taking into account the risk of falls and the reliability of her walking ability, it is unlikely that her level of mobility would be above 20 metres for the majority of the time.

Should the DWP accept our recommendation as above it means that she scores highly enough to retain the use of her mobility car. Please note that this has no connection to the Mandatory Reconsideration".


We now have to wait for the result of the Mandatory Reconsideration, but if that is unsuccessful, at least we have more evidence to take to a tribunal.

I was able to assist her thanks to the knowledge I have gained from using the Guides on here for my own case - they are invaluable. I would also advise anybody have problems to contact their MP, it is surprising how quickly the DWP suddenly track down missing paperwork, and respond in a timely manner!

I would check with the DWP that they have received a copy of this letter and if not send them a copy.
