Hi. I'm in same situation as yourself
I've had ESA (CB) for 365 days.
I then sent additional info as I wanted to ensure I sent enough paperwork/info &
Went on to ESA (IR) . It was a shock when I heard I needed to complete another ESA50. I have a WCA thus Thursday, ( yes they are re-assessing my ESA after 6 months which I believe is not unusual.
Gordon/mods. Should I fail WCA
1. I will not apply for Job Seekers Allowance whilst Appealing, it could go against me.
2 final question if lose it & I appeal will I still get my payment or will it be halted until after Appeal/MR and then possibly tribunal? I'm working through your excellent advice ( ESA relating to Mental Health.
As we all know, when this all comes back & bits us on the derrier it really does knock you back.
Hope to hear, &'apologises if I missed it in info. Fuddled brain, & not surprising!

Please don't post your questions in other people's topics it's really unfair to the original poster.

1. The Tribunal are limited to looking at you conditions as they were at the time of the Decision they cannot taking into account your claiming JSA subsequently.

2. If you are found Fit for Work then your ESA will stop until and if you make a request for an appeal at which point you can receive the ESA Assessment rate.
