You did reply on other topic, but I had omitted to mention what I wrote below and regarding the assessor. It said the additional evidence I had sent had gone to the ATOS assessor who had said they would not change their decision. I had thought it would go to DWP decision maker. I did explain this and apologised as well for not posting all in same place as I could find it on my phone. Sometimes I am frightened to post on here for fear of the response I will get. I am struggling with my mental health and the replies can be a bit abrupt which is upsetting with all what is happening to me at the moment.

I'm sorry I missed your question. Decisions are made by the DWP, however, the DM has no medical knowledge so is heavily dependant on the assessor for this.

Please don't read anything more into my previous post than that I had replied in your other topic. I'm now the only Moderator posting and although posting levels are not what they were earlier this year I am still dealing with 200-300 questions a week. so I'm afraid I only have time to provide answers.

I have had to come back to the forum for advice as I am totally confused and feel unwell. I put in my MR over 8 weeks ago and have just received the notice. It looks hastily put together and I got it after I contacted my MP to ask for their help. They asked them to expedite things. First page and scores same as previously. Next page the decision same as before. Then a sentence saying 'we received your additional medical evidence which we sent to the assessment provider and now have their supplementary report. They don't include this or give any mention of what it contains . I got the assessors original report eventually after many weeks and they just seem to quote form that.

Then the rest of page standard information about how they reach their decisions. Next page saying they haven't changed their decision and then comments from the assessors report from original decision, no mention of what is in supplementary report and no mention of the evidence that has been provided with MR which addresses the points the assessor made.

Next page mentions making a MR and that you have to wait for decision before making an appeal. There is no mention of making an appeal now. I thought the MR notice would mention appealing?

Can I appeal now or do I have to wait again and make another MR? I am sorry but I really do not understand what to do hence having to post again.

The rest of the pages are all badly photocopied with text missing about reporting changes nothing about appeal.

I cannot get anyone to help me with this. I contacted a law centre who made me an appointment for 12 th August which is too far away and I will miss the deadline. I told them what the date of the MR notice was but they said that's the best they can do and no guarantee they can help plus it is miles away and I dont think I will mange with my disability. This is a terrible nightmare. I am in hell.

The key document to look for is a Mandatory Reconsideration Notice it will be at the top of the page and there should be two copies of it, one for your records and one which needs to be sent to the Tribunal Service with your request for appeal.

The PIP Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

OK. Thank you. The letter does say MR notice. There is only one copy so will have to send original. There was no mention of why they have turned down my MR just to say they sent it to ATOS and they have sent a supplementary report but don't tell me about it. It just confused me as it says 'You have one month to apply to a MR form the date of this letter. You must do this before you can appeal. It then doesn't tell me anything about appeal process or time limit email etc. Also I don't think I could be anymore detailed than what I have been on my review form and then my MR as I went through it all again in detail. I can't keep up anymore

I am wondering if it is worth pursuing a complaint and would like some advice please?

I only got the result of my MR after contacting my MP and then I got my decision notice. The DWP only sent one copy of MR Notice (not two). They didn't give any detailed reasons for refusing to change their decision. Just cut and paste sections of the assessors report. These were things such as 'The assessor did not think you were in pain.' The assessor never asked and I was. I also provided medical evidence. I got no points for using an aid for communicating (I use a hearing aid), I got no points for needing social support mixing with people. I have a social services package of care and have a support worker to provide this who came to assessment with me. I also sent it a detailed letter from them on headed paper detailing what they do and what support needs I have. I only go out once a week with them. None of this evidence was considered even letters from GP and hospital. I pointed these discrepancies out but still 0 points. I also asked them to explain why my award was reduced to nothing from high rate daily living considering things have got worse in last two years, I got no answer.

I have filled in appeals form and enclosed my only copy of MR Notice.

Is it worth complaining about these issues or just leave it all for appeal.? (I covered all these aspects in my appeal letter).

A side note is they have deprived me of several years of Christmas bones. I have managed to get back 2 years but they wont go back further. They only did this after my MP wrote to them. If I did complain about the other years of Christmas bonus they wont give me back would I have to mark this as a separate complaint than the one to PIP( If I did complain about issues with assessment)..
