Hi
Had my home assessment last week. The lady was really lovely and despite me being a wreck I was able to get through it.
I received my copy of the report this morning and am absolutely flabbergasted. I am currently on higher rate DLA for both care and mobility and the points that she has ticked on the report would give me 8 and 10 respectively, meaning I would go down to standard rate for both.
Throughout the report there are inconsistencies, ommissions, lies and half truths. There are so many I don't know where to begin.
I have just rung the dwp (in tears) and they have arranged a callback. Apparently no decision has been made yet. I sent in over 50 pages of evidence and 30 pages of additional information that I couldn't fit in the tiny boxes on the form.
I'm not sure what to do, do I go through each issue with them over the phone or am I better telling them I will send it to them in writing? I also have the added issue of the fact that I have an audio recording of the assessment. This was done because my dad was taking notes but wears 2 hearing aids and was worried he would mis-hear or not hear something. The assessor was not aware he was recording. Do I tell them that I have audio that can back up some of the issues I have with the report?

Any advice is very gratefully received!

Unfortunately there is little advice that I can offer until a Decision is made, the DM is not bound by the assessors report but usually follows it.

Be aware that the criteria for DLA HRC and PIP Enhanced Daily Living are fundamentally different, so if you are going to argue for the EDL then it needs to be solely on the basis that you should have scored 12 points and not because of the DLA award.

Technically, the 10 points for Mobility, which I assume is because you were assessed as being able to walk 20m-50m is equivalent to the DLA criteria for HRM. Can you show that your walking is restricted to 20m or less or that you should have scored points for the Going Out activity.

Hi Gordon

Yes I based everything on the PIP criteria. I definitely should have scored at least 2 points on the Going Out activity.

Any advice on whether I should inform them I have an audio recording?

It's not going to make any difference for the MR, the DM won't accept it as evidence, this may be different at a Tribunal.

I've just had mine and I'm a mess. I should have got in theory enhanced in both sections. Or at least standard care but top mobility.
Most of the actual writhing she put seems ok thou some areas are incorrect. But the mobility sections totAlly wrong. Even thou it states I can't walk more than 20 meters max. But she's ticked the 50-200 box saying that's more probable? I took my scooter right up to the door. Only walked.. 3 meters. I have scoliosis c o p d Asthma restricted lungs. High b p lots more. It's impossibly to walk unaided that far. Plus my b f drives comes out with me. I cant use public transport for various reasons which was disgusted. So should have had several points in both sections. Only got 4 so I'm cured it looks like. Any advice would help. Sounds like it's almost everyone they lie about. Been through this with e s a too and won at tribunal x So will keep fighting.
