PIP SOCIAL ENGAGEMENT AND TRIBUNAL ADVOCAC was created by DRAGON2009
If you are able tp represent yourself at a PIP tribunal is that 'social engagement' or is participation in a legal process in essence different to 'social' engagement ? I am wondering what happens in these situations, I'd imagine many claimants do so without losing actual or potential points but surely some must have had difficulties. I suppose if depends on what level of social difficulty they claim to have So for example the claimant who can speak well enough at their hearing but with a friend or partner present would be one thing, whereas if they attended alone and were claiming the greatest level of social impairment that would be another matter. But in these days of shortage of available representation it is more frequently the case that people need to try and speak for themselves however challenging that might be. ?

There is no clear answer to this as it depends on how your conditions affect you.

There is Case Law, see the PIP Claim guide, in this area which says that formal occasions such as an assessment or a Tribunal should not be assumed to be social contact by default.

I can certainly say that members have lost appeals by attending when their stated limitations suggested that they should not have been able to, but we also have members who have been able to explain how they managed it and have received an award.

Attending with someone else will certainly defuse the situation.

Thank you Gordan , I will have a look. I rather think a person who can deal with official things when essential or highly indicated as to be recommended (especially when accompanied) is a different thing to the ability to deal with less structured contact in the community. Its a shame 'social' was not defined in the legislation.
