I've seen the letter you mention but what I was wondering was whether to write my MR letter in a similar format to the appeals format or just write requesting the MR & include any new evidence? As the DM has quite obviously only used the Capita HP's flawed report, my instinct is the former?

Due to the amount of evidence I sent in with my original application I only have a couple of new bits. I have now received a copy of my last DLA assessment which was done by an ATOS HP (he's actually an A&E consultant at the hospital I'm under). On requesting it I was told that that report had to be requested from their "back office" as it was for my DLA & it's not in the system with my PIP info!? I wonder if it's worth including as it not only gives a more accurate report but I'd have thought that a Dr's opinion would carry more weight than an OHT? Plus he actually examined me where as she didn't (even though she reported that she did!).

Sending new evidence with no explanation of how it relates to your limitations is unlikely to be effective, you are asking someone with no medical training to draw conclusions about how you are affected from information that is medical in its nature. They may of course refer the information back to the assessor for their comments, but again, what seems obvious to you may not be so to someone else.

Including the DLA report may help but you must address two issues; that you are still affected to the same degree or worse as the report details and you also need to refer it back to the PIP activities, although DLA and PIP look at substantially the same areas, the assessment approach is very different, so you must explain the relevance.
