Hi, Is there a specific format for the letter/report that I have to do for my Tribunal Appeal?

Although you can write a letter I would recommend that you actually fill in the Appeal request form (SSCS1).

The ESA Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your ESA50, the assessment report and the ESA Claim guides to see how you might show this is the case.

Hi Gordon,
I have done all that and am in the process of going through all the paper work from DWP. What I would like to know is there a best format for the tribunal appeal report I will present?

There's no prescribed format but I would do the following;

- Number all pages
- include your full name, National Insurance Number and Tribunal Reference Number on each page.
- write in clearly broken paragraphs and number each one starting from 1.

Consider the following;

- write a one paragraph summary of why you are appealing
- write a one long sentence summary of each issue you are raising.
- provide a detailed explanation of each issue
- attach any additional evidence to the back rather than spreading it through the document
