A second mandatory reconsideration notice

Dear Advisors

Yesterday I received a second MC notice. This one called Following your appeal. I have already been awarded 9 points for mobility and 6 points for standing and sitting and this new MC notice gives me a further 6 points for bowel incontinence, so 21 points in all.
Despite this they have decided I am available for WRA ( work related activity ) which means that my money has been reduced by almost £200 a month.
Now I have phoned the Court this morning and they say they have not received the bundle and therefore my appeal is still current and that the Judge has decided to wait a bit longer for the papers from the DWP.
However the letter says that if I wish to pursue the appeal ( which I do!) I now have 12 days to do so or the appeal will lapse.

What do I do?

I'm not sure why the Tribunal Service have asked whether you want to continue with the appeal, although you appear to have scored extra points from this second MR it has not actually improved the award that you already had so there should be no reason for there to be concern over your continuing with the appeal.

However, since the question has been asked then I recommend that you contact the TS and confirm, assuming that you do, wish to continue with the appeal.

According to the 2nd MC letter I have to make contact by 9/10/17? And submit a second appeal by 26/10/17. So I have written a letter to the decision maker saying I am submitting a second appeal. I am about to go to the post office and track and trace the letter and the second appeal, another £12 I cannot afford. The court however said this morning that the bundle from the first appeal has still not arrived, so their view is that the first appeal is still standing.

The 2nd MC letter deffo states that if I do not make contact by 9/10/the appeal will lapse and I do not want to fall at the last hurdle as this has been going on now since December last year!

Just thought you should know what is happening in the marvelous world of UC
