I received a mandatory reconsideration notice for ESA they haven't changed their decision that no limited capability for work not revised because you didn't score 15 points required let me quote 'you requested a mandatory consideration on groundsale that you get help from the father of your child for child care,as well as shopping and other things. You'very problems with your leg, back&groin and you have started physiotherapy
I spoke over the phone it took 2 3minutes roughly requesting mandatory reconsideration
But today got a letter that it doesn't relate to any activity within work no new information supplied but still the first decision some of the comments are wrong they have statementsome from my doctor that I am unfit to work health care professional has a different role from a GP

May you please help me to appeal to tribunal I have back pain (spondylitis changes with loss of facet joint space) abnormalities in the lower back as per scan results and syphilis pubis as shown in xray
Am on pain killer co_dydramol 2tablets 4hourly but not more than 8 a day
Recently started physiotherapy through ORTHOPAEDIC SURGEON REQUEST

In 2weeks am having PPI assessment again can you help me am just frustrated with everything

Thanks

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

The ESA Appeal guide has links to the SSCS1 form that you will need to complete and the Submissions guide has a complete example that you can use to help you fill it in, you do not need to provide detailed reasons at this stage for your request.

Once your appeal is accepted the DWP will prepare their submission to the hearing and send you a copy, whilst you should wait until you receive this to finish and submit your own, you should start to prepare your own case, an increased award will only be made by your showing that you score the extra points for one, so I would start by going back through your PIP2, the assessment report and the PIP Claim guide to see how you might show this is the case.

ESA has very specific criteria that the claimant has to meet for an award, your post and the response from the Decision Maker suggests that although you have explained your problems, what you have included does not relate to this criteria and this is why your claim has been unsuccessful.

I would start by going through our ESA Claim guides to understand what you are being tested against , compare this to your answers on the ESA50 you complete to see whether you have explained yourself correctly.

If you have further questions then please reply to this post and we will do our best to help.
