Dear Gordon
I was just wondering, will people who are in receipt of PIP and ESA be moved onto Universal Credits. Or are they Exempt? I am a bit confused as I always thought the way we receive our benefit would stay the same, and we wouldn't have to claim Universal Credits

PIP is not a UC benefit and will not be effected.

ESA claimants are supposed to start being migrated to UC and New ESA from 2019, but I think that this is optimistic.

I understand that only income-based ESA claimants will be moved to UC. Contributory ESA claimants won't be moved to UC.

We will have to wait and see what happens in 2019 but I expect ESA(CB) claimants to be migrated to New ESA, otherwise they will have "ESA" claimants being managed on two different systems with two different sets of legislation.

Sorry for giving out misleading info regarding ESA(CB); it's just that I'd read on various web sites that those on ESA (CB) support group would not be affected by UC. If as you say Gordon, we could at some point be moved to New ESA (what ever that is) under the UC umbrella; what would it mean for us? Will it mean a reduction in payments perhaps, or even reassessment under the UC regulations? I'm totally confused. After being migrated from Invalidity benefit to Incapacity benefit, and then to ESA, and an expected 2nd ESA reassement next year (not to mention my recent move from DLA to PIP) it seems that I may now have to battle through another change in 2019. Any info you can give me on this would be appreciated. Many thanks,

New ESA is effectively the same as ESA(CB) is now, same rates, etc., the only real difference is that it is controlled by the ESA Regulations 2013 rather than the 2008 ones, these are part of the Regulations enacted for UC.

As to how the transfer will be done, we will have to wait until the process starts in 2019 (if then), as it will require Transfer legislation to be put into law.
