I am rally sorry but as an Interview Under Caution has been done and there is talk of criminal proceedings we cannot give advice on the forum.

You need to get trained welfare and legal face to face advice. Do an internet search for "welfare advice" with your postcode, town or county.

Dear Gordon, I don't find this very helpful. It is not likely to go to court unless I decline to pay the admin penalty. I have already paid back the overpayment and believe it is really unfair to threaten someone to have to pay another 50% penalty when one has done nothing wrong. This site is meant to help people who are being unfairly treated by the DWP and it would have been really helpful to me to have got others perspectives, before I make my final decision whether or not to pay the Admin Penalty. I have already extensively searched online and cannot find any welfare advice organisations other than CAB, who have already indicated that they do not have the capacity to help me much with this, other than give basic advice.....

I'm sorry but as soon as they required am IUC this became a legal matter and we were no longer qualified to offer you advice, but even if we were qualified, it would be irresponsible of us to provide such advice in response to a post on an open forum.

You have the option of requesting a Mandatory Reconsideration or If unsuccessful an appeal.
