Hi, My daughters PIP renewal is not due until next June, however they sent out a booklet to see if there were any changes, which we filled in and said that my daughters condition had got worse on some of the questions. next thing we knew was that an appointment had been made for a face to face consultation at our home. I then requested a copy of that report and wondered who he was talking about. PIP have now sent out a new award, (even though it was not due) and have decided to take my daughters car away from her ( her life line ) and have only awarded her Standard rate living allowance and only 4 points for mobility. Can they do this? What can I do?

I'm afraid nearly all PIP awards are being reassessed a year in advance of the award ending, the PIP Legislation allows the DWP to reassess a claim at any time.

If you disagree with the new award then the first stage to challenging the Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

Your primary task is to show that she meets the criteria, there are many reasons she may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.
