Just wanted to rant. Have just got my PIP letter. I have been on DLA for years for mobility and middle rate of care. It was awarded indefinitely. I have now been awarded Standard Mobility and Standard Care, I'm devaGPstated!

I am 64 years of age and the lies that have been told on the letter I have received I cannot believe. Does this happen to other people? Because of this I went to see my GP this morning and she convinced me that I am ill and not 'swinging the lead' as was intimated by the DWP.

I have a neurological illness called Dystonia, not a well known illness but 3rd most common illness after MS And Parkinsons. I have lived with this illness for 24 years which came on me at the same time I was treated for breast cancer.

The person who was doing the assessment was a physiotherapist she told me, not someonw who was well informed on neurological illnesses. She has not put down on the paperwork the answers to the questions she asked me. I've also been told that the antidepressants I am on Citalopram (40mg) are a low dose tablet. No so my GP tells me they are the highest I can be on. She says that the normal dose is 20mg. How can they not check these meds especially as I was told the decision makers were not medical?

Also the physio said that I did not move in 30 minutes, again my GP said that I could not possibly sit for 30 minutes in the same position, that I would have to be a good actor to do that! AlsoI was crying all through the assessment with the stress, she wrote that I laughed and smiled appropriately! She did not mention I was upset.

I am going to appeal this decision, at 64 do they think I'm 'swinging the lead'? I am losing my car and everything else that goes with that. Apart from the DLA and ESA which I was awarded the higher amount after being seen by a doctor, I do not claim anything.

I'm sorry to write like this ( I haven't done this before) but I am in total despair.

Thanks for listening. x

Welcome to the forum, you might want to have a look at the following FAQ which explain where everything is

Welcome to Benefits and Work

In case you are not aware, your real name appears to be showing in the forum, if you want to change this then follow the instructions in the following FAQ

My full name is showing, how can I stop it?

The first stage to challenging a Decision is for you to request a Mandatory Reconsideration, this needs to be done in writing to the DWP, within one month of the Decision, to the office that dealt with your claim, have a look at our PIP MR & Appeal guide for details of the process, the PIP area also has template letters that you can use to make the request with.

www.benefitsandwork.co.uk/help-for-claimants/pip

You should contact the DWP for a copy of the assessment report if you have not already done so, I would phone them but again follow up the request in writing. Once you have the assessment report you will have a better understanding of how the DWP Decision Maker has come to their conclusions and will then be able to argue against them.

Your primary task is to show that you meet the criteria, there are many reasons you may have failed, you need to address each of these but don't get bogged down in criticising the assessment report unless you can clearly show that it is incorrect, it is a lot easier to argue the facts of the situation;

"the assessor recorded that I walked 50m, I did but they have failed to document that I had to stop every 10m for a rest due to breathlessness"

than their opinions

"based on my observations of the claimant walking I believe that they can reliably walk more than 200m.

When you have a better idea of the issues with your claim, come back to the forum and we will do our best to help.
