My dad had to go from DLA to PIP and has lost it. I am currently doing his mandadtory reconsideration. For each descriptor I think he should have got points for do I have to write a load of stuff out again?

Also all throughout the assessors report it says the MSE noted and so on. I've since found out this me4ans mental state examination. What has this got to do with being deaf? He scored no points on questions he should have as he canno do some things safely because they state the MSE notes adequate congnition. What's that got to do with being unable to hear things? Does everyone who has a face to face have a mental health examination? He was asked to spell the word world backwards and so on.

When I challenge it is it best to just state the facts and not openly state any lies?

I would certainly highlight any issues that you think the report contains, but try and stick to ones that directly effect your father scoring points, the issues you raise in your post would not seem to do this so I would think twice about mentioning them,

You do not need to repeat information that is included in or with his PIP2, but you should make sure that the information supplied meets the criteria to score points. You can refer the Decision Maker back to the form with any additional information that you think is required.

I have been reading about the new case law about completing an activity safely. How do I mention that? Do I state the case law? For example being deaf dad cannot hear in the bath if the smoke alarm were to go off. Do I say this and state he should score points as he cannot do it safely and then say something about the case law?

Decision Makers have now received a memo about the new guidance but I would not rely on them having read it so I would include a reference to the UTT Decision and then explain why you think your father is covered by it.
