Hi,
I wonder if anyone can help me?its very complicated.
I was diagnosed with fibromyalgia and chronic fatigue syndrome in 1992 with help of painkilling meds I was able to fulfill a fabulous career as an interior designer.
Until 2008 the boot of my car hydrolics failed and took the whole weight of the tailgate on my neck causing damage to my spine resulting in a double discetomy and a 6” steel plate in my neck.
Resulting in me not being able to do my job anymore.
I was put on ESA but not until 18 months later I was informed I was in contribution based work focused group.ive never been on benefits so didn’t know there was a difference between support and work focused group, I was just happy to be receiving some income until it all stopped some one year later when they told me I had to claim Jobseeker’s Allowance, but I was unfit for work? I was informed they would pay my NI stamp and nothing else. I then applied for PIP and was given high rate until 2018 then someone from citizens advice told me I should be on ESA support group as I will never be able to work again. They appealed for me and I was turned down as I was to late to appeal in claiming support groups do that was in 2012. As to date I have sought citizens advices help to try again to get support group ESA as they say because they pay my NI stamp and my health is worse they can reassess my work capabilities as if placed in support group this can be linked back to my contribution based claim to reinstate payment.
They helped me fill in ESA form and heard nothing for 12 weeks,so I rang them and was told it was the wrong form it should be ESA 3 so now I’ve had to pay my doctor for a medical report then write a letter to ESA saying why I think I should be reconsidered for ESA support group, nightmare.

The ESA3 form is to check whether you are eligible for Income Related ESA, something that the DWP should have checked when they stopped your payments.

If you have reported a change of circumstances then they should be reassessing you to see whether you meet the criteria for an SG award.

We can offer more advice but as your appear to have an advisor I recommend that you speak to them first about the current situation as there seems to be some confusion about what is going on.
