Hi, I am helping my brother David for his tribunal. We managed to get some extra evidence from his GP and I will get 3 letters from friends who have seen him during his various state of epilepsy.

His wife who wanted to go to the medical assessment with him was sidelined and now we are going to tribunal, I asked her to be a witness. However, the idea has completely freaked her out. Even with me asking her basic questions like how long does an episode last, she freezes and eventually says - I don't know. If she does this with me, she will be useless at the tribunal.

The only other option is to ask her to supply a letter describing each point and what happens. I appreciate this isn't the best result but I really don't want to put her or us through the tribunal.

My question is - Will this be ok? or will this be damning?

Sorry, should have put this on my first question.

It was apparent that my brothers specialist had been recommending he add a new drug to manage his epilepsy. My brother had refused. The Pip people knew about this and almost every answer in the Tribunal pack rams this point.. Since initial refusal and the appeal refusal, he has started this medication and it has not made any difference.

I understand that if his health has changed he may need to reapply and not go to tribunal. But is there a way to use the fact that he has started this medication to no avail to counter their claims??

It may not carry as much weight as her testimony at the hearing, but if she is not capable of giving that testimony then it's a good second best.

My advice, if she goes t the hearing is not to let her in the room.

Yes, use the lack of improvement to counter aby arguments about his not taking it initially.
