A friend of mine has been off of work for 11 months in a disability discrimination dispute. A settlement has now been agreed offering compensation, for the discrimination, and a loss of earnings payment.

Her SSP ran out in August and therefore she has been claiming CB-ESA since then.

Is the ESA repayable, as they will soon be getting a loss of earnings payment that will cover the very period for which the ESA was paid?

I can only find information on repayment of ESA relating to a personal injury claim.

I'm sorry but I cannot give you a definitive answer, their solicitor should be able to offer advice and if necessary set up a trust fund to hold the monies.

However, I don't believe that the DWP will try to recover any money as it is not related to the reasons that they are claiming ESA, but I could be wrong!
