My last two assessments, 2013 & 2015 were carried out at my home because of serious brain injury/stroke and chronic Polymyalgia Rheumatica and Chronic and Severe Arthritis. I have substantial mobility issues and am worried that I may be required to attend one of their centres. If this was to occur and they could not be persuaded to grant a home visit, I would have to be taken. But more importantly I would have to take a much larger than usual dose of Morphine. I currently take 100 mg of prolonged release (Zomorph) a day, and 10 ml of Morphine Sulphate (oral) 4 x a day. To be able to travel to a centre I would need to increase this dosage substantially to enable me to physically travel. But this amount of Morphine would put me in a perilous condition, and would certainly put me at a disadvantage at assessment as being so heavily medicated would hide my pain symptoms and to frank I would probably be so sedated I would be asleep. I also suffer TIA's and Hemiplegic Seizures and the effect of this journey and medication would possibly trigger a seizure. What duty of care does the assessor have in deciding whether a home visit is necessary? Could they be held liable for the consequences of forcing me in to a dangerous situation and putting me at risk? Regards

They have a duty of care for all visitors to their offices, but I doubt this extends to liability, especially if you are self medicating.

If you have problems with a home visit then you need your GP to provide a letter stating why you cannot attend at the Assessment Providers offices, you should also consider contacting your MP.

Thanks Gordon,

I was more concerned about being assessed whilst heavily sedated, and whether the assessors would be happy to proceed with me being incapacitated by 'prescribed' medication.

Capita have previously been happy to carry out a home visit and I cant really see them having grounds to now insist on my attending an assessment centre.

Surely their duty of care extends further than their front door when it is they who determine if one has to make that journey?

I would be very surprised if they accept any liability outside of their building, any choices about your journey would be yours and not theirs, I know this sounds harsh and does not represent the financial necessities of your needing to continue to receive a benefit, but it likely does meet the legal ones.

If you medicated to the point where you could not take part in the assessment then you could be classed as failing to participate and could be required to attend another assessment.
