I recently won my Tribunal and was placed into the Work Related Activity Group and received a letter from the DWP confirming this.

I have a couple of questions regarding the letter I received from the DWP.

Firstly, do I have to continue to send the DWP sick certificates from my GP? The letter I received from the DWP makes no mention of this.

Secondly, the letter I received from the DWP states 'We may still credit you with National Insurance contributions while claiming ESA'. I had been receiving contribution based ESA prior to my Tribunal. My payments stopped earlier this year as I had reached the maximum 365 day limit. The DWP had continued to credit me with National Insurance contributions during the duration of my appeal. The word that concerns me in the DWP letter is 'may'. Without National Insurance contributions I would be in the WRAG, but receiving nothing from the DWP

If the DWP have acknowledged the WRAG award then you should not need to send Fit Notes again.

ESA letters are badly worded, as long as you continue to meet the criteria for an award of ESA, you will receive NI Credits that count towards your State Pension.

Have you checked whether you are eligible for Income Related ESA? ESA(IR) is dependant on your household income, your savings and assets, and any hours that your partner works. See
