Just a quick one

Lost my MR.

Starting an appeal now, can I just attach my MR submission as the grounds for appeal. It has all the information in and is quite detailed.

Also, I'm sure I read somewhere that previous reports/decisions should be taken into account, is that correct?

My main bone of contention with the decision is that I got 0 points for taking nutrition. My previous 2 awarded 4 points. Both of those HCP reports had similar comments to this one, and if anything my condition has worsened (mental health) something evidenced by stronger medication. I did point this out in my MR but the DM has completely ignored it,

Yes you can attach your reasons for the MR to the SSCS1 but you don't have to provide detailed reasons at this stage and there could be an advantage to your providing a single detailed document for your appeal once you receive the DWP's submission.

Appeal panels are now requiring the DWP to provide details of any previous award so that they can see whether changes to the claimants conditions are consistent with any new award.

There is an interesting News Article (see the News section on the left of the page) about the accuracy of PIP assessment reports which you might want to have a read of.

This is what I have wrote so far

I do not believe the points awarded were correct. I believe the HCP did not understand the severity of my problems.
I do not believe the decision maker who looked at my mandatory reconsideration took into account or considered the points I made properly.
I have attached a copy of the mandatory reconsideration which goes into detail of what I do not agree with.
I also do not think the DM has taken previous reports into account when assessing my claim. My previous 2 assessements awarded 4 points for taking nutrition, yet this one has scored 0, despite the HCP reports being broadly similar in content, and my condition being worse than before. This is evidenced by the stronger medication I am now prescribed.
I also believe the points awarded for preparing food and engaging face to face were lower than should have been awarded.


If I don't have to provide details at this stage, should I just write the 3 areas I disagree on, not include the MR then provide full details after I get the DWP submission? I didn't know if they would ask for further details later or if the only stuff that would be counted was what I wrote now. I would rather just provide a short statement now and do the detailed one later, but obviously not if it affects the appeal :)

Thank you again, is there a link to a guide on the appeal stage, I've read the MR one and although it seems to say you can do the same for the appeal, I didn't see the stages of appeal listed there.

There's a sample completed SSCS1 in the Submission guide.

It's up to you whether you provide details now or later, but having done several appeals there is always something that pops in the DWP submission and it can lead to a mixed message if you have to send in two documents.

Apart from the hearing itself, an appeal is no different from an MR in as much as you are trying to show that you meet the criteria for an award, if there is a difference it is that you know all of the assessors and the DWPs arguments.
